Property Registration in India — Steps, Documents, Stamp Duty and Costs
Registering a property purchase has five steps: title verification, drafting the sale deed, paying stamp duty (typically 4–8% of the property value, varying by state and buyer gender) plus ~1% registration fee, executing the deed before the sub-registrar with two witnesses, and post-registration mutation. Registration is compulsory for sales of immovable property above ₹100 — an unregistered sale passes no title.
சட்டப்பூர்வ காலக்கெடுக்கள்
- 1–2 weeks — Title check + agreement to sell (before paying big money)
- Days — Stamp duty + slot booking (e-stamp and sub-registrar appointment)
- 4 months — Present deed for registration (from execution (s.23 Registration Act))
- Weeks — Mutation after registration (municipal/revenue records update)
படிப்படியாக: என்ன செய்வது
- 1
Verify title before anything else
30 years of chain, encumbrance certificate, approvals.

இதை உங்களுக்காகச் செய்கிறோம் — ₹299Have an advocate examine the chain of title (ideally 30 years), the encumbrance certificate from the sub-registrar's office (shows mortgages/charges), current tax receipts, approved plan and occupancy certificate for built property, and RERA registration for under-construction flats. This step is where fraud dies — duplicate sales, mortgaged property and fake owners are all caught here, and no later step fixes a bad title cheaply.
- 2
Draft the sale deed properly
The deed is the title document your family will rely on for decades.

இதை உங்களுக்காகச் செய்கிறோம் — ₹199The sale deed recites the parties, the property schedule (boundaries, survey/flat numbers), the consideration and payment mode, possession delivery, and the seller's covenants of clear title and indemnity. TDS applies on purchases of ₹50 lakh+ (1% under Section 194-IA, deducted by the buyer). Get it drafted professionally — WakilBhai's sale-deed service (₹199) prepares a registration-ready deed.
- 3
Pay stamp duty — the state-wise variable
4–8% typically; concessions for women buyers in several states.
விவரங்களைப் பார்க்கவும்
Stamp duty is a state subject: typical residential rates run 4–8% of the higher of consideration or the government guideline/circle value, with concessions for women buyers in states like Delhi (4% vs 6%) and UP, plus ~1% registration fee (often capped). Metro cess and surcharges add fractions in some cities. Pay via e-stamp/e-GRAS for the exact computed amount — under-stamping surfaces at registration or, worse, in future litigation with penalties up to 10x. Register at the sub-registrar, then mutate
Biometrics, witnesses, and the record update afterwards.
விவரங்களைப் பார்க்கவும்
Book the sub-registrar slot (most states online), appear with the seller and two witnesses, carrying IDs, PANs, photos, the deed and duty proof; execution is recorded with photographs/biometrics (Section 32A Registration Act), and the deed must be presented within 4 months of execution (Section 23). Collect the registered deed (same day to a couple of weeks). Then apply for mutation in municipal/revenue records — it does not confer title but aligns tax records and prevents later disputes; banks releasing loans insist on the full set.

இந்தப் பிரச்சினைக்கான இலவச வடிவங்கள்
அடிக்கடி கேட்கப்படும் கேள்விகள்
Is property registration compulsory?
Yes — Section 17 of the Registration Act makes registration compulsory for sale of immovable property worth over ₹100, i.e., effectively every sale. An unregistered sale deed does not transfer ownership and is inadmissible to prove title; at best it supports limited defensive rights. Never close a purchase on notarised papers alone.
How much stamp duty will I pay?
Depends on your state, the property value (higher of actual price or circle/guideline rate), buyer gender and location: most states charge 4–8% plus about 1% registration fee. Delhi, for instance, charges 6% for men and 4% for women buyers. Run your numbers on our free stamp duty calculator before budgeting.
What is the deadline for registering a signed sale deed?
Four months from execution (Section 23, Registration Act), extendable by another four months with a penalty up to 10x the registration fee (Section 25). Practically, sign and register on the same day — gaps between signing and registration are where disputes and second sales breed.
What is mutation, and is it the same as registration?
No. Registration records the transfer of title; mutation updates municipal/revenue records so property tax and land records show your name. Mutation does not create ownership but skipping it causes friction in resale, loans and inheritance — apply right after registration with the deed copy.
Can I pay less duty by under-declaring the sale price?
Duty is charged on the higher of the declared price and the government circle rate, so under-declaration mostly does not save duty — and it constitutes evasion with penalties, invites income-tax scrutiny (Section 56 deems the difference income), and caps your future capital-gains base. Declare the real price.
Do NRIs follow a different registration process?
The process is identical; the practical differences are executing through a registered power of attorney if not present (POAs executed abroad need attestation/adjudication), FEMA limits on the kinds of property NRIs may buy (agricultural land is restricted), and TDS at higher rates when NRIs sell. A pre-purchase consultation sorts these in one call.
