Power of Attorney for Property — Types, Registration, NRI Use and the Sale Ban
A power of attorney lets someone act for you in property matters — but know its limits: the Supreme Court (Suraj Lamp, 2011) holds that property cannot be SOLD via GPA; sales need registered sale deeds. POAs authorising registration or dealing with property should themselves be registered (₹500–2,000 typical duty); NRIs execute before the Indian consulate and get it adjudicated/stamped in India within 3 months of receipt.

The Suraj Lamp rule — no property sales by GPA

In Suraj Lamp v. State of Haryana (2011) the Supreme Court held that the GPA-plus-agreement-plus-will "sale" package does not transfer title — immovable property passes only by registered sale deed. A POA can authorise the attorney to execute and register a deed on the owner's behalf, which is legitimate; a POA sold as the transaction itself is a void shortcut. Buying property "on GPA" is buying litigation — walk away or regularise with a proper deed.

Execute before witnesses; notarise management POAs, and register at the sub-registrar those authorising registration/dealing with immovable property (several states mandate it; duty typically ₹500–2,000, but POAs to non-relatives authorising sale attract near-conveyance duty in some states — an anti-evasion rule). NRIs: execute before the Indian Embassy/Consulate, then have it stamped/adjudicated in India within 3 months of receipt (Section 18, Stamp Act); apostille routes also work for Hague countries. Registrars reject vague or stale POAs — recent, specific, registered wins.

Is buying a flat "on GPA" safe if it's cheap?
No — after Suraj Lamp, a GPA "sale" conveys no title: you get possession and paper, not ownership; resale, loans and inheritance all jam. The discount is the price of the defect. Either the seller executes a registered sale deed (possibly via a POA-holder, which is fine) or the deal isn't one.
Does my POA need registration or is notarisation enough?
Management/rent/litigation POAs: notarisation generally suffices. POAs authorising execution/registration of documents or dealing with immovable property: register them — several states mandate it, registrars demand it, and a registered POA forecloses later authenticity fights. When in doubt for property, register.
How does an NRI give a POA for property in India?
Sign before the Indian Embassy/Consulate (or notary + apostille in Hague countries), courier it to India, and have it adjudicated/stamped within 3 months of receipt, registering where the use requires. The attorney then acts with that POA + your ID proofs. Specific-purpose POAs sail through registrar scrutiny fastest.
Can my attorney sell the property to himself?
Self-dealing is a classic abuse: unless the POA explicitly authorises sale to the attorney (rare and scrutinised), such transfers are voidable for breach of fiduciary duty and fraud. Draft with express prohibitions, price floors, and sale-proceeds routing to your account — and prefer special POAs naming the intended buyer.
The property owner died — is the POA still valid for the pending registration?
No — agency ends at death; a deed signed by the attorney after the principal's death is void, however genuine the transaction. The legal heirs must execute instead (succession steps first — see our succession guide). Check principal-alive status is a registrar's standard question for stale POAs.
