Registered chit funds are governed by the Chit Funds Act, 1982 — disputes go to the Registrar of Chits, whose arbitration awards are enforceable as decrees, and the foreman's security deposit with the Registrar backs your claim. Unregistered "committees" (BCs) are contract + criminal territory: acknowledgements, legal notice, civil suit — and cheating/criminal-breach-of-trust FIRs where the organiser absconds.     Establish what the scheme legally is

    Check whether the chit is registered (chit agreement, registration number, Registrar of Chits of the state — ask or verify at the registrar's office). Registered chits give you the Act's machinery and the foreman's 100% security deposit held with the Registrar. An informal committee/BC is a mutual contract among members — enforceable, but without the statutory net. A scheme promising fixed "returns" to non-participants may be an unregulated deposit scheme — squarely inside the BUDS Act, 2019 with its attachment machinery.

    Collect your chit passbook/receipts, bank/UPI records of contributions, the member list and the agreement (or chat records for informal BCs — the group chat usually documents everything). Send the foreman/organiser a written demand; for prized-but-unpaid or wound-up chits, follow with the ₹999 advocate's notice to the foreman and sureties. Members who received the pot and stopped contributing get the same treatment — their liability to the fund is several and provable.

    Under Sections 64–71, Chit Funds Act, disputes between subscribers and foremen go to the Registrar (or nominee) as arbitrator — filing fees are small, procedure summary, and the award executes as a civil decree, with the foreman's security deposit available. Complain in parallel to the Registrar's supervisory side: registrars can inspect, freeze fresh chit business, and wind up defaulting foremen — pressure that produces settlements.

    Organiser vanished or diverting funds? File the FIR immediately — cheating Section 420 IPC (now Section 318 BNS) and criminal breach of trust Section 406 IPC (now Section 316 BNS); group FIRs by multiple members get economic-offences-wing attention. For unregulated deposit schemes, the BUDS Act empowers the state's competent authority to attach the scheme's and promoters' assets and repay depositors through designated courts — ask the district collector's office who the notified competent authority is, and get every victim to file. Speed decides recovery: attachable assets evaporate.

Our committee was informal — no registration, just a group. Is my money legally recoverable?

Yes — an informal BC is a contract among members: your contribution record and the group's chats/records support a civil claim against the organiser (and pot-takers who stopped paying). It lacks the Chit Funds Act machinery, so the route is notice → suit/Lok Adalat, plus FIR where dishonesty is evident.

What does the foreman's security deposit mean for me?

A registered chit's foreman deposits 100% of the chit value with the Registrar before starting. On default, arbitration awards can be satisfied from it — which is why the registered-chit route has meaningfully better recovery odds than informal committees.

The organiser is paying some members and stalling others. Does that matter legally?

Selective payment strengthens the dishonesty inference for the criminal complaint and shows funds exist — cite it in the FIR and the Registrar complaint. It also justifies urgency: interim attachment (civil or BUDS) before remaining funds are distributed to favourites.

Is a "double your money" or fixed-return scheme the same as a chit?

No — a chit rotates the members' own pot by auction/lot; a scheme taking deposits against promised returns is deposit-taking, which unregistered entities cannot lawfully do. BUDS Act 2019 criminalises such schemes and provides the attachment-and-repayment machinery; report to police and the competent authority.

Many of us are affected. Do we file together or separately?

Both: one joint/group FIR (or multiple FIRs consolidated) for the criminal side — numbers move EOW/police priority — and individual claims (arbitration/suit) for your specific amounts. Coordinated victims also file the BUDS application together, which accelerates the attachment decision.
