Court Marriage Under the Special Marriage Act — Notice, 30 Days, Documents and Cost
A court marriage (Special Marriage Act, 1954) works for any two adults — across religions, or anyone preferring a civil ceremony: give 30 days' written notice to the Marriage Officer of the district where either party has lived for 30+ days, and after the notice period (if no valid objection) the marriage is solemnised before the officer and three witnesses. Government fees are a few hundred rupees; the certificate issues the same day.

The notice is displayed at the office (and sent to the permanent-address district if different). Objections (Section 7) must allege a legal impediment — existing marriage, underage, prohibited degrees — and the officer inquires and decides within 30 days of the objection; rejection of frivolous objections is appealable in your favour. Family displeasure is NOT a legal objection. Couples fearing harassment: police protection can be sought (courts, following Lata Singh, protect adult couples' choices), and safety planning around the notice display is legitimate — take advice.

After 30 days (and within 3 months of the notice, else it lapses), the marriage is solemnised at the office (or within reasonable distance on payment): both parties declare in the prescribed words before the Marriage Officer and three witnesses (any adults with ID — friends work; parents are not required). Sign the register; the marriage certificate issues — conclusive proof for passports, visas, banks and everything after. Total government fees typically run ₹100–1,000 by state.

Can the 30-day notice period be skipped?
No — it is statutory under the SMA. What varies is everything around it: online filing, appointment efficiency, and solemnisation promptly on day 31. Couples needing immediate marriage sometimes solemnise religiously first (valid under personal law) and register that marriage — different consequences; take advice for your facts.
Will my parents be informed of the notice?
The notice is displayed publicly at the marriage office, and a copy goes to the permanent-address district office if different — the law does not send personal notices to parents, but public display means discovery is possible. Adult couples' right to marry is protected; if you apprehend interference or violence, protection mechanisms exist — plan with advice, not fear.
Who can object to the marriage, and on what grounds?
Anyone may object within the 30 days, but only on legal grounds — existing spouse, age, prohibited relationship, incapacity. The officer inquires (max 30 days) and must reject non-legal objections; wrongful refusal is appealable to the district court. "We disapprove" has no legal standing.
Do witnesses have to be family members?
No — any three adults with valid ID (friends, colleagues) serve as witnesses. This matters for couples marrying without family support; no parental consent or presence is legally required for adults.
Is a court marriage certificate valid for passports and visas?
