Employment Bonds in India — When "Pay ₹2 Lakh If You Leave" Is Actually Enforceable
Training bonds are not automatically void — but they are enforceable only as reasonable compensation for genuine investment: real, costed training, a proportionate bond amount, and a sensible period. Courts cut inflated figures to actual loss (Section 74, Contract Act), and post-employment non-competes are void (Section 27). An employer's remedy is money, never forced service or seized certificates.

Bonds operating during employment (serve X years after funded training or compensate) are not restraints of trade — they are valid promises, IF: the employer shows genuine, quantifiable investment (certified training, courses, onboarding programmes with real cost), the amount approximates that investment, and the period is proportionate. Under Section 74, Contract Act, courts award reasonable compensation not exceeding actual loss — the ₹5 lakh bond for a two-week induction gets slashed. No — that is the popular myth. Bonds compensating genuine training investment are valid contracts; what the law refuses is penal enforcement: amounts get trimmed to proven actual loss, and service can never be compelled. The practical question is always "what did they really spend on you?"
I resigned 8 months into a 2-year, ₹3 lakh bond after a 1-month training. Exposure?
Realistically: the demonstrable cost of that month's training (often modest), possibly pro-rated for your 8 months served — not ₹3 lakh. Demand the expenditure break-up, offer the reasonable figure, and hold. Most employers settle or drop at that point.
The company is holding my degree certificates until I pay the bond. Legal?
No — retaining an employee's original certificates as bond security is unlawful pressure; courts and even police (for refusal after demand) treat it seriously. Demand return in writing, escalate with the ₹999 notice, and note that their unlawful retention weakens whatever bond claim they had.
I signed a blank cheque as bond security and they threaten a cheque-bounce case. Serious?
Yes — treat it seriously: a filled-and-bounced cheque creates Section 138 proceedings you must defend (the defence: no legally enforceable debt beyond actual training cost, and the blank-cheque circumstances). Get advice immediately, put the disputed-liability position in writing NOW, and negotiate the cheque's return in any settlement.
Can they stop me joining a competitor citing the bond?
No — post-employment non-competes are void under Section 27, and no injunction will stop your new job. What survives: confidentiality/trade-secret duties and, during employment, exclusivity. The bond's money claim (if genuine) and your career move are separate lanes.
