No statute forces a private employer to issue a relieving letter in most sectors — the pressure comes from contract, dues, damages and process. That pressure works; silence does not.

Is a company legally required to give a relieving letter?

No general statute mandates it (some state shops & establishments rules require service certificates), but contractual exit terms, the implied obligation to close a concluded employment, and the damages your blocked joining creates give real legal pressure. Practically, the advocate-notice stage releases most letters.

They say "clear the notice-period recovery first". Can they hold documents hostage?

Genuine contractual dues can be set off in the FnF — but inventing or inflating them to hold your career hostage is actionable pressure. Dispute the computation in writing, offer to settle genuine amounts, and let the notice demand the documents against that settlement. Courts frown on document-hostage tactics.

I absconded without serving notice. Do I still have rights?

Weaker ones — the employer can claim notice-period recovery and refuse a clean letter citing the abandoned exit. Best path: negotiate now — offer the buyout amount against issuance of documents, in writing. Even absconders are entitled to earned salary for days worked and their Form 16.

New employer needs the letter this week. Any faster bridge?

Offer the documented-exit bundle: resignation email + acceptance, last salary slips, bank statements showing salary credits, and the FnF/asset-return trail. Most BGV processes accept this with a declaration. Simultaneously fire the advocate notice — a same-week release under notice pressure is common.

Can I complain to the labour commissioner just for documents?

For workmen-category employees, yes — document and FnF grievances ride together in conciliation, and employers attending conciliation almost always hand over papers to close the file. Managerial employees use the notice + civil route instead.
