Anticipatory Bail Explained — When It Applies, Process and Typical Costs
Anticipatory bail is a court order directing that if you are arrested in a non-bailable case, you are released on bail immediately — Section 438 CrPC, now Section 482 BNSS. You apply to the Sessions Court or High Court before arrest, through an advocate; typical advocate fees run ₹10,000–₹50,000+ in Sessions Courts. This page explains the process; it is not legal advice.

- Immediately — Consult an advocate (the moment you fear arrest / see the FIR)
- Days — File in Sessions Court (drafting + filing usually within the week)
- First hearing — Interim protection possible (courts often protect until final order)
- Next step — High Court if rejected (a Sessions rejection is not the end)

Understand what it is — and is not
Pre-arrest protection in non-bailable cases, on conditions.

Anticipatory bail (Section 438 CrPC, now Section 482 BNSS) is a direction that if the police arrest you in the named case, you are released on bail at once — you never sit in custody. It is for non-bailable offences where arrest is feared (a hostile FIR, a family dispute turned criminal, business complaints). It does not stop the investigation, and courts refuse it in the gravest offence categories and where custody is genuinely needed.

When to move, and to which court
FIR registered or credible arrest threat — Sessions Court first, usually.
વિગતો જુઓ
You can apply once there is a registered FIR naming you or a reasonable apprehension of arrest. The application normally goes to the Sessions Court first (the High Court is the alternative or the appeal path after rejection). It states the case facts, why arrest is unnecessary, your roots in the community, and your undertaking to cooperate. Courts frequently grant interim protection on the first hearing while the state replies.

The hearing and the conditions
The order comes with conditions — breaking them cancels it.

The public prosecutor opposes or concedes; the court weighs the FIR's gravity, your antecedents and flight risk. Typical conditions on grant: join the investigation when called, do not contact witnesses or tamper with evidence, do not leave the country without leave, and furnish a bond. Violating a condition gets the bail cancelled — treat the order's terms as strict law until the case ends.

Why this is advocate territory
This is a contested court proceeding — not a form-filling exercise.

વારંવાર પૂછાતા પ્રશ્નો
When should I apply for anticipatory bail?
As soon as there is a registered FIR naming you, or a concrete reason to fear arrest — a police notice, a complaint you know is being converted into an FIR. Applying early lets the court grant interim protection before any arrest attempt; applying after arrest is too late (that becomes regular bail).
How long does anticipatory bail last?
Following the Supreme Court in Sushila Aggarwal (2020), anticipatory bail is not automatically time-limited — it can protect you until the end of trial unless the court itself restricts its duration or cancels it for violation of conditions.
Can anticipatory bail be rejected? What then?
Yes — gravity of the offence, custodial-interrogation need, or weak drafting all sink applications. A Sessions Court rejection can be taken to the High Court (and in rare cases beyond). Strategy on where to file first is exactly the judgment call your advocate makes.
Does anticipatory bail mean the case is over?
No. The investigation and trial continue normally — you simply face them from liberty rather than custody. You must join the investigation when summoned and honour every condition; the protection is from arrest, not from the case.
Why can't I file it myself to save the fee?
The statute does not bar it, but this is an argued, contested proceeding against the public prosecutor, where drafting and oral argument decide outcomes and a rejection creates a record the next court reads. In practice, self-represented anticipatory bail applications fare poorly — this is the one place not to economise.
