In Naveen Kumar v. Vijay Kumar (2018) the Supreme Court held the person named in the RC is the "owner" for MV Act liability — even after sale and delivery. Practically: e-challans, road-tax arrears, and accident compensation claims from the buyer's driving can be pressed against you until the record changes. This is why "RC transfer is the buyer's problem" is the most expensive myth in used-vehicle sales.

Most buyers comply — the transfer benefits them too. If a MACT claim arrives, appear through an advocate immediately and implead the buyer as the person in possession and control; your intimation record is what shifts the burden. Potentially yes — Naveen Kumar holds the registered owner liable under the MV Act regardless of sale. Your defences are the Form 29 intimation, sale documents and impleading the actual possessor. File the intimation today even if the sale is old; late protection beats none.
Challans keep coming in my name for the sold vehicle. Do I pay them?
Contest, don't pay: respond with the sale note and Form 29 acknowledgement, naming the buyer. Virtual Courts and traffic authorities accept documented "sold and intimated" responses. Paying silently, conversely, reinforces the record that the vehicle is yours.
The buyer has vanished with the vehicle. What are my options?
File the Form 29 with everything you know of the buyer, lodge a police complaint recording that the vehicle is in unknown hands despite sale, and write to the RTO seeking notation/action. This trail — intimation + complaint — is what protects you when the vehicle surfaces in a wrong-doing.
Can the RTO transfer the RC without the buyer's cooperation?
The scheme expects the buyer's Form 30, but on a seller's persistent representation with complete sale proof, RTOs can proceed against the buyer (show-cause, penalty) and courts have directed record corrections. It takes follow-up — the advocate's notice + RTO complaint combination is the practical lever.
Does informing my insurer matter too?
Yes — tell the insurer of the sale and stop renewing the policy in your name. An active policy in your name reinforces registered-owner liability and pays claims that then get litigated around you. The buyer must insure it; that pressure also pushes the transfer.
