Is property registration compulsory?

Yes — Section 17 of the Registration Act makes registration compulsory for sale of immovable property worth over ₹100, i.e., effectively every sale. An unregistered sale deed does not transfer ownership and is inadmissible to prove title; at best it supports limited defensive rights. Never close a purchase on notarised papers alone.

How much stamp duty will I pay?

Depends on your state, the property value (higher of actual price or circle/guideline rate), buyer gender and location: most states charge 4–8% plus about 1% registration fee. What is the deadline for registering a signed sale deed?

What is mutation, and is it the same as registration?

No. Registration records the transfer of title; mutation updates municipal/revenue records so property tax and land records show your name. Mutation does not create ownership but skipping it causes friction in resale, loans and inheritance — apply right after registration with the deed copy.

Can I pay less duty by under-declaring the sale price?

Duty is charged on the higher of the declared price and the government circle rate, so under-declaration mostly does not save duty — and it constitutes evasion with penalties, invites income-tax scrutiny (Section 56 deems the difference income), and caps your future capital-gains base. Declare the real price.

Do NRIs follow a different registration process?

The process is identical; the practical differences are executing through a registered power of attorney if not present (POAs executed abroad need attestation/adjudication), FEMA limits on the kinds of property NRIs may buy (agricultural land is restricted), and TDS at higher rates when NRIs sell.
