How much interest can I claim for delayed possession?
The RERA-prescribed rate in most states is around SBI's highest MCLR plus 2% per annum, applied to the entire amount you have paid, for every month from the promised date until actual possession. On a ₹50 lakh payment, that is roughly ₹45,000–50,000 per month of delay — which is why builders settle.
Can I get a full refund instead of waiting?
Yes — Section 18 lets you withdraw from the project and claim the full amount paid with interest, plus compensation. Courts have held the choice is the allottee's, not the builder's. Practically, refunds from stressed builders take enforcement effort; interest-and-possession is often the faster real-world outcome in live projects.
Do I need a lawyer for a RERA complaint?
Not mandatorily — the forms are online and many buyers self-file interest claims successfully. Refund claims, builder counter-arguments (force majeure, buyer default) and REAT appeals are where professional drafting visibly changes outcomes. The builder blames COVID/approvals for the delay. Does that excuse them?
Only within limits. Authorities extended registrations for defined force-majeure windows, but promised possession dates in agreements otherwise bind the builder — vague "approval delays" are routinely rejected as excuses since obtaining approvals is the builder's statutory duty. The delay computation resumes after any officially granted extension.
My project is not RERA-registered. Can I still complain?
Yes — twice over. Non-registration of a coverable project is itself a violation (penalty up to 10% of project cost), and you can file against the builder before RERA for that plus your relief; the consumer commission remains open as well. Report the unregistered project on the state portal — authorities act on these.
What if the builder ignores the RERA order?
Execution is built in: RERA orders are enforceable as decrees, and unpaid amounts are recoverable as arrears of land revenue through the district collector — attachment of the builder's bank accounts and property. Persistent defiance also draws Section 63 penalties (daily fines) and, ultimately, imprisonment provisions.
