    Build the proof of the loan

    Collect the bank/UPI transfer records (the single best evidence), chats and messages where the borrower acknowledges the loan or promises repayment, any promissory note or cheque, and witnesses to the arrangement. A fresh written acknowledgement extends the 3-year limitation (Section 18, Limitation Act) — so a WhatsApp message saying "I'll return it after Diwali" is worth engineering before relations sour completely. Cash loans without any trail are the hardest; acknowledgements become everything.

    With written proof (transfer + acknowledgement/promissory note/cheque), file a summary suit under Order 37 CPC — the borrower must obtain the court's leave to defend, cutting off delay tactics. For modest sums, the small causes court (where your state has one) is faster and cheaper. Court fees are ad valorem on the claim (state slabs); claim interest from the due date.     At any stage — even before filing (pre-litigation) — the matter can be placed before a Lok Adalat (nalsa.gov.in): a settlement reached there is a decree, final and unappealable, and court fees already paid are refunded. I lent cash with no proof. Can I still recover it?

Harder, but yes — the claim then rests on acknowledgements. Get the borrower to admit the loan in writing (chat, email, voice note): "return my ₹50,000" answered with "next month, promise" is evidence. Witnesses to the lending and to demands also count. Build this record before sending any notice.

What is the time limit to sue for money lent?

Three years from when repayment fell due (or from the loan date if no due date was fixed), under the Limitation Act. Every written acknowledgement of the debt within that window restarts the three years — which is why keeping the borrower talking on record matters.

Is lending money to a friend even legal without documents?

Yes — an oral loan is a valid contract. Documentation only affects provability, not legality. (Very large recurring lending can attract state money-lending laws, but one-off personal loans between friends and family are outside them.)

Can I file a police complaint instead of a civil case?

Generally no — failure to repay is a civil dispute, and police will (rightly) refuse. A criminal angle arises only with cheating from the start (borrowed with no intention to repay — hard to prove) or a bounced cheque (Section 138 NI Act, a genuinely effective criminal lever).

How does pre-litigation Lok Adalat work for money disputes?

Apply to the District Legal Services Authority to place the dispute before the next Lok Adalat; the other side is invited, a conciliator brokers terms, and any settlement is recorded as a binding award with decree force. No fee, no appeal, relationship intact — the best first forum where both sides still talk.
