    Know the rules agents must follow

    Under RBI's Fair Practices Code and outsourcing guidelines, lenders answer for their agents, who must: contact you only between 8:00 am and 7:00 pm at agreed places, carry identity and authorisation from the lender, and never use abuse, threats, public shaming, or contact with your family/colleagues to humiliate you. RBI's charter and circulars make the bank accountable for agent misconduct — that accountability is your lever.

The lender must respond — silence or a brush-off for 30 days opens the Ombudsman door.

    Agents who threaten harm commit criminal intimidation — Section 506 IPC (now Section 351 BNS); abuse and public humiliation can amount to insult intended to provoke breach of peace — Section 504 IPC (now Section 352 BNS); unlawful entry or seizure of assets without due process is trespass/extortion territory. File at the local station or on cybercrime.gov.in for phone-based harassment. What are recovery agents legally NOT allowed to do?

Call outside 8 am–7 pm, use abusive language or threats, humiliate you before family/neighbours/colleagues, visit at odd hours or in intimidating groups, seize assets without due legal process, or operate without the lender's authorisation letter. Each violation is a Fair Practices Code breach the bank answers for — and threats are independently criminal.

Can agents seize my vehicle or belongings for an unpaid loan?

Not by force. Even for hypothecated vehicles, the Supreme Court has repeatedly held repossession must follow due process — notice and lawful means, not musclemen. Forcible seizure is theft/extortion territory; note the incident, file the police complaint, and put the bank on notice.

Does complaining stop the loan from being recovered?

No — and that is fine. Your complaint targets the method, not the debt. Interest and the lender's civil remedies (suit, SARFAESI for secured loans, arbitration) continue. Use the breathing room to negotiate restructuring or a settlement in writing through official channels.

What can the RBI Ombudsman actually give me?

Directions to the lender to fix the deficiency, and compensation — including up to ₹1 lakh for mental agony and harassment in deserving cases. Beyond your case, Ombudsman findings feed RBI's supervision of the lender, which is why banks settle these complaints quickly.

The calls are about someone else's loan — I am just a reference or a relative.

You have an even cleaner case: the lender has no recovery claim against you at all. Write to the grievance officer demanding your number be removed and harassment stop; escalate identically to the Ombudsman. Continuous calls to third parties are textbook Fair Practices violations.
