Money Recovery

Cheque bounce, unpaid loans, pending dues and advocate-sent demand notices.

If someone owes you money — a bounced cheque, an unpaid loan, or pending business dues — start here. A lawyer-drafted demand or Section 138 cheque-bounce notice costs ₹199–₹999 and goes out in 1–3 working days. The law then gives the other side 15 days to pay. If they don't, a cheque-bounce complaint must be filed within the next 30 days, and the case itself can take several months to a few years. The guides below explain every deadline; get your notice drafted or talk to a lawyer free on WhatsApp.

Chit Fund or Committee (BC) Default? Recovering Your Money from Foremen and Members

Registered chit funds are governed by the Chit Funds Act, 1982 — disputes go to the Registrar of Chits, whose arbitration awards are enforceable as decrees, and the foreman's security deposit with the Registrar backs your claim. Unregistered "committees" (BCs) are contract + criminal territory: acknowledgements, legal notice, civil suit — and cheating/criminal-breach-of-trust FIRs where the organiser absconds. The BUDS Act 2019 adds attachment of assets for unregulated deposit schemes.

Friend or Relative Not Returning Borrowed Money? Notice, Court and Lok Adalat Options

To recover money lent to a friend or relative: first a written demand with a deadline, then an advocate's legal notice (₹999 with WakilBhai; most matters settle here), then court — a summary suit under Order 37 CPC where you have written proof, or small causes court for modest sums. File within 3 years of the loan falling due. Lok Adalat is the free settlement forum on the way.

Gave a Loan Without Any Paperwork? How to Still Recover Your Money

A loan without documents is still a valid debt — the problem is proof, and proof can be built now: bank/UPI transfer records, witnesses, and above all a fresh written acknowledgement from the borrower (a WhatsApp "I'll return your ₹2 lakh soon" is evidence and resets the 3-year limitation). Engineer the acknowledgement first, then the ₹999 legal notice, then suit or Lok Adalat.

Bank Recovery Agent Harassment? RBI Fair Practices Rules and Where to Complain

Recovery agents of banks and NBFCs are bound by RBI's Fair Practices Code: calls only between 8 am and 7 pm, no abuse, threats or public humiliation, and agents must carry the lender's authorisation. Document the harassment, complain in writing to the bank's grievance officer, and escalate free to the RBI Ombudsman after 30 days. Owing money never legalises intimidation.

Lok Adalat: How the Free Settlement Court Works — Dates, Process and Finality

Lok Adalats settle disputes by agreement with the force of a civil-court decree — free, fast, and final (no appeal). National Lok Adalats run roughly quarterly across every court complex; pending cases can be referred, and pre-litigation disputes (money claims, bank dues, challans, family settlements) can be placed directly through the District Legal Services Authority. Court fees already paid are refunded on settlement.

Time Limits for Money Recovery in India — The Limitation Rules That Decide Cases

Most money claims die by delay, not merit: the Limitation Act gives 3 years for loans, invoices, and contract dues — counted from when payment fell due. Two lifelines reset the clock: a written acknowledgement of the debt (Section 18) and a part-payment (Section 19), each restarting 3 years. Cheque-bounce criminal complaints run on far shorter clocks (30 days after the notice window). Know your dates before you negotiate.

Client Not Paying Your Invoice? Business Dues Recovery — Notice, MSME Route and Summary Suit

For unpaid business invoices: written follow-ups with a deadline, then a ₹999 advocate's notice with interest, then court — a summary suit under Order 37 CPC on your written trail. If you hold Udyam (MSME) registration, the strongest lever applies: buyers must pay within 45 days, delayed payments carry compound interest at 3× the RBI bank rate, and MSME Samadhaan facilitation councils enforce it. Limitation: 3 years per invoice.
